The term ‘Clayton Partners Ltd’ or ‘Electacourse’ or ‘us’ or ‘we’ refers to the owners of the website whose company registration number is 08220179. The term ‘you’ refers to the user or viewer of our website.
All prices are in pounds sterling (GBP) exclusive of VAT. VAT is charged at the prevailing rate.
We only sell brand new products and services.
Most products and services are immediately available for accessing online, some exam simulators are immediately available for download. When an item is pre-ordered and money is taken for that item, an expected availability date will be communicated explicitly with the customer prior to purchase.
Your order represents an offer to us to purchase a product or service, which is accepted by us when we send email confirmation and/or a redirect to a webpage which provides details of how we have made that product or service available to you. That acceptance will be complete at the time we send the order confirmation email and/or web page redirect to you.
Some of our products are supplied as online services. When you purchase an online service, you are expressly agreeing to the terms of the End User License Agreement. Acceptance of these Terms and Conditions includes acceptance of the End User Licence Agreement.
When you place an order to purchase an online product, you will have created an account with Electacourse. On completion of your order you can navigate to your Online product from the My Online Content link in the website menu.
Your use of the Online product is tracked. Once you have visited more than 5% of the Online product, you agree you have completed your examination of the services as defined by the Distance Selling Regulations. In clear language, if you have visited more than 5% of the Online product you cannot claim any refund for your purchase.
Many of our online products require recurring payments to remain available to you. These service is referred to as a ‘Subscription’.
We will try to process your Subscription promptly, but we do not guarantee that your Subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a Subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your details, at which point we will create an account and provide you with access to your Subscription. We reserve the right to reject any offer in our discretion, for any or no reason.
You must not impersonate or try to impersonate another person, disclose your password to anyone else, use anyone else’s account or allow anyone else to use your account.
1. Prices and Payment
You may receive a ‘free trial’ as part of your Subscription. When the free trial period finishes your Subscription will automatically continue at the price quoted on the Site during the sign-up process, unless you cancel in accordance with the instructions set out below before the end of the trial period.
You agree to pay the price at the rate notified to you at the time you take out your Subscription. We may modify the price of any Subscription, remove and/or offer certain other subscription services from time to time. We will always tell you in advance of any increase in the price of your Subscription and offer you an opportunity to cancel it if you do not wish to pay the new price.
2. Renewals and Cancellations
Your Subscription will automatically renew for the same Subscription period (e.g. weekly/monthly/annually). Upon renewal, we will charge the current Subscription price using the same card or other payment method that you previously used.
If you took a Subscription with a ‘free trial’, you may cancel the Subscription at any time before the trial period expires. Unless you cancel prior to the end of the free trial period, your Subscription will automatically continue as a paid-for Subscription.
You agree that your Subscription will begin as soon as we send you the email confirming your Subscription. You will not have the right to cancel the Subscription within the active Subscription period, save for any ‘free trial’ you might be entitled to (see above).
3. How to cancel
To cancel your Subscription you will need to log in to your account using your email address or username and the password you created when you purchased your Subscription.
Once logged in go to My Account > Subscriptions where you can see the option to cancel your subscription
Access to your Subscription content will remain until your next recurring payment would have been due.
Your subscription term, your rights to cancel your Subscription and/or your rights to receive a refund may differ if you used a promotional code or other offer. Further details will be set out with the relevant offer.
If after login and first glance of the material to which you have subscribed, you then consider it may not be up to your expectation, we will consider cancelling and providing a refund. To discuss this with us, use the contact form to explain your reasons for seeking a refund. We are not able to give a refund if our data shows that you have used the material for more than just a first glance.
Some of our products are supplied as downloadable files.
When you place an order to purchase a downloadable item from us, we will send you an email and/or redirect you to a web page, confirming receipt of your order and containing the details of your order and how to collect the item(s).
On completion of a download order you will be able to access links that will allow you to download your purchased files. You can download up to three copies within the period that the link is valid. The files will be licensed to you, however, and are not for resale or distribution.
By clicking the download link that provides you with immediate access to digital content as soon as you complete your purchase, you expressly waive your right to withdraw from this purchase.
Before downloading purchased files, please ensure you are familiar with the processing of downloading files from the internet and saving them to your computer or internet connected device. We cannot be responsible for failure to download purchased files. Review the FAQ page for information about how to download your files.
By downloading files from Electacourse you are expressly agreeing to the terms of the End User License Agreement.
Electacourse grant you the right to make a single copy of your download purchase for the purposes of back-up. The back-up file can be used to restore your purchase in the event of hard disk failure or other fault of the computer to which you have downloaded the files. Electacourse cannot supply customers with further downloads of their purchases.
Download purchases cannot be cancelled. Please see the section above about download sales.
If you experience a problem when downloading material or if you encounter a broken link, please inform us immediately using our contact form, giving details of the item and your order number.
We will make every effort to ensure that downloads which you have purchased are available for collection immediately or at any time within two working days of the date of purchase. It is possible, however, that at times of very heavy demand or in case of exceptional technical problems you may be asked to collect your file(s) at another time.
Some Electacourse products include City & Guilds exams. The City & Guild exam needs to be taken within 12 months of the date of your purchase of this product, after this period Electacourse are not obliged to provide the exam.
Electacourse will no longer be obliged to provide the exam if within 12 months of purchase, the following conditions apply:
- Your initial choice of exam centre is no longer available and that after Electacourse has offered you two alternative exam centres you have refused both alternatives. Electacourse will refund you £100 and discharge our obligation to provide you with the exam.
- City & Guilds discontinue the exam: on request from you or by our own action (whichever is first), Electacourse will refund you £100. An upgraded exam to match new editions of the relative regulations, does not count as the exam being discontinued.
Electacourse exam booking service
Electacourse act as an agent for accredited examinations centres. Electacourse makes exam bookings for our customers at an accredited examination centre on receipt of a correctly completed the exam registration form which is made available to customers who have purchased a product which includes a City & Guilds exam.
Once you have submitted the exam registration form and we have confirmed the date you requested, you need to attend the exam on that date. If we have not been able to get the date requested on your form and we have subsequently communicated with you and you have agreed to an alternative date which we have then booked, you need to attend on that date. Once booked, your exam booking cannot be transferred to another centre.
If you inform us prior to the scheduled exam date of your intention to not attend, we can reschedule the exam at your request at the same centre for another date within 28 days at no charge. We cannot guarantee the centre will have availability within 28 days (it is unlikely our partner centres which are categorised as Other Centres, will have availability within 28 days). If you cannot attend within the 28 days or the centre does not have availability, and you want Electacourse to make an exam booking on your behalf, you will need to repurchase the exam booking.
By use of the Electacourse exam booking service, customers agree Electacourse has no liability related to customer’s attendance at accredited examation centres.
We use the world-leading e-commerce providers called Braintree (a Paypal company) and Stripe to process purchases made on the website. Your card data is transmitted over a secure SSL connection and encrypted with AES-256, the same standard as approved by UK and US governments for top secret data. Electacourse do not ever see your credit card details.
We use PayPal to process online and telephone transactions. Any credit card information we take over the phone is not stored by Electacourse.
Warranties and liability
The material displayed on this website is provided without any guarantees, conditions or warranties as to its accuracy.
Unless expressly stated to the contrary to the fullest extent permitted by law, Electacourse and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever.
These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
