Terms and conditions

Clayton Partners Ltd and its affiliates provide access to the website (the “website”) and sell downloads of data, goods and services to you, subject to the terms and conditions set out below. By using the website, you agree to be bound by these terms and conditions which together with our privacy policy govern Clayton Partners’ relationship with you while you use this website.

The term ‘Clayton Partners Ltd’ or ‘Electacourse’ or ‘us’ or ‘we’ refers to the owners of the website whose company registration number is 08220179. The term ‘you’ refers to the user or viewer of our website.

All prices are in pounds sterling (GBP). We charge VAT on all products. The prices displayed on the website includes VAT at the prevailing UK rate  (currently 20%). If you are purchasing our products from a country in the EC, the VAT element of the price is calculated at your country’s applicable VAT rate. This does not affect the VAT inclusive price paid.

For customers purchasing from countries elsewhere in the world, we can supply at VAT exclusive prices providing the order has a net value of greater than £1,000. Contact us directly if this applies to you.

We only sell brand new products, not used items.

Most products are immediately available for download. When an item is pre-ordered and money is taken for that item (as we use PayPal, this is standard procedure), an expected availability date will be communicated explicitly with the customer prior to purchase.

Download sales

All our products are supplied as downloadable files.

When you place an order to purchase a downloadable item from us, we will send you an email and/or redirect you to a web page, confirming receipt of your order and containing the details of your order and how to collect the item(s). Your order represents an offer to us to purchase an item, which is accepted by us when we send email confirmation and/or a redirect to a webpage which provides details of how we have made that product available to you. That acceptance will be complete at the time we send the order confirmation email and/or web page redirect to you.

You will then be able to access links that will allow you to download your purchased files. You can download up to three copies within the period that the link is valid. The files will be licensed to you, however, and are not for resale or distribution.

By clicking the download link that provides you with immediate access to digital content as soon as you complete your purchase, you expressly waive your right to withdraw from this purchase.

Before downloading purchased files, please ensure you are familiar with the processing of downloading files from the internet and saving them to your computer or internet connected device. We cannot be responsible for failure to download purchased files.

We offer customers the opportunity to purchase a Back-up CD which contains copies of your downloadable files.

By downloading files from Electacourse or by opening the CD packaging you are expressly agreeing to the terms of the End User License Agreement.

Delivery times for Back-up CDs

See our shipping information for more details.

Sending the Back-up CD order

At the time you make your download order, add a Back-up CD to your cart and pay for it. You will receive an order confirmation once your Back-up CD has been accepted; this email will tell you that you’re due to receive a second email when we dispatch your Back-up CD.

Secure web ordering and credit card payment

We use an e-commerce provider called SendOwl to process purchases made on the website. SendOwl refer purchase requests by secure https to the Clayton Partners Ltd PayPal gateway to receive payment.

We use PayPal to process our transactions. They’re reliable, secure and you don’t need an account in order to use the service. PayPal process orders for customers who wish to use their credit or debit cards.

Download purchases cannot be cancelled. Please see the section above on download sales.

If you want to cancel your order for a Back-up CD, please notify us as soon as possible. It may be that your order will already have been dispatched and we are unable to recall it. We cannot guarantee to cancel items from an order. Cancellation requests must be logged via our contact form, quoting your order number.

Guarantees and returns

All items are guaranteed to be brand new and should reach you in perfect condition.

We will only replace items that are defective or sent in error. Please see our refund and returns policy for more information.

This is subject to you notifying us of the problem and returning the product to us within thirty days of receipt of the goods and providing a description of the damage or defect. Please contact us before returning items. Report faulty items using the link below and we will give you return instructions.

Broken links or download error

If you experience a problem when downloading material or if you encounter a broken link, please inform us immediately using our contact form, giving details of the item and your order number.

We will make every effort to ensure that downloads which you have purchased are available for collection immediately or at any time within two working days of the date of purchase. It is possible, however, that at times of very heavy demand or in case of exceptional technical problems you may be asked to collect your file(s) at another time.

After-sale use

After an item has been purchased and downloaded onto your data storage device (e.g. computer, or any medium on which data can be stored, whether existing now or in the future), you are permitted to make copies exclusively for your own private and domestic use.

We strongly advise you to make a back-up copy of your downloaded files on a secure storage device. Computers and data storage devices frequently fail with the consequence of complete loss of data. In these cases we are not able to supply customers with a reactivated download link. In exceptional circumstances we may consider offering customers to repurchase their downloaded product at discounted price.

We offer a Back-up CD option where we will copy a customer’s order to a CD and dispatch the CD to the customer. We are unable to replace lost Back-up CDs.

Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
